1. Agreement to Terms

By accessing and using the website prospectrentalservices.com and by making a booking with Prospect Rental Services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

These Terms and Conditions constitute a legally binding agreement between you (“Guest”) and Prospect Rental Services (“Host,” “we,” “our,” or “us”).


2. Booking and Reservations

Making a Booking:

  • All bookings are subject to availability
  • A booking is only confirmed upon receipt of payment and our written confirmation
  • You must be at least 18 years of age to make a booking
  • The person making the booking is responsible for all guests in the party
  • You must provide accurate and complete information when booking

Booking Confirmation:

  • You will receive a booking confirmation email upon successful payment
  • Please review your confirmation carefully and contact us immediately if there are any errors
  • Keep your booking confirmation for reference throughout your stay

3. Payment Terms

  • A deposit of 30% of the total booking amount is required at the time of booking
  • The remaining balance is due 7 days before check-in
  • All prices are listed in US Dollars (USD)
  • Prices include all applicable taxes and fees as displayed at checkout
  • Payment is processed securely through Stripe
  • We accept all major credit and debit cards

4. Check-in and Check-out

Check-in:

  • Standard check-in time is 3:00 PM (15:00) Central Time
  • Early check-in may be available upon request, subject to availability
  • Check-in instructions will be sent to your email 24 hours before arrival
  • Our properties feature keypad self check-in — no need to meet in person

Check-out:

  • Standard check-out time is 11:00 AM (11:00) Central Time
  • Late check-out may be available upon request, subject to availability and additional fees
  • All keys, access cards, and property items must be left as instructed

5. House Rules

By making a booking you agree to comply with the following house rules:

Occupancy:

  • Maximum occupancy must not be exceeded at any time
  • Unauthorized guests are not permitted
  • All guests must be listed at the time of booking

Noise and Neighbors:

  • Quiet hours are from 10:00 PM to 8:00 AM
  • Parties and events are not permitted without prior written approval
  • Please be respectful of neighbors at all times

Smoking:

  • All our properties are strictly non-smoking indoors
  • Smoking is only permitted in designated outdoor areas
  • A deep cleaning fee of $250 will be charged for violations

Pets:

  • Pets are permitted only at properties that explicitly state “pets allowed”
  • An additional pet fee may apply
  • Guests are responsible for any damage caused by pets

Property Care:

  • Treat the property with respect and care
  • Report any damage or maintenance issues immediately
  • Leave the property in a clean and tidy condition
  • Dishes should be washed and trash disposed of properly

Security:

  • Ensure all doors and windows are locked when leaving
  • Do not share access codes with unauthorized persons
  • You are responsible for the security of your personal belongings

6. Damage and Security Deposit

  • Guests are responsible for any damage caused during their stay beyond normal wear and tear
  • We reserve the right to charge the payment method on file for any damage costs
  • We will provide documentation of any damage charges within 72 hours of check-out
  • Disputes regarding damage charges must be raised within 7 days

7. Guest Responsibilities

As a guest you agree to:

  • Use the property only for lawful purposes
  • Not engage in any illegal activities on the premises
  • Not disturb neighboring properties
  • Comply with all applicable local laws and regulations
  • Report any issues, maintenance problems, or safety concerns immediately
  • Vacate the property by the agreed check-out time

8. Our Responsibilities

Prospect Rental Services agrees to:

  • Provide the property in a clean, safe, and well-maintained condition
  • Ensure all listed amenities are available and functional
  • Respond to maintenance issues promptly
  • Provide accurate descriptions and photos of our properties
  • Keep your personal information secure and confidential

9. Limitation of Liability

To the maximum extent permitted by law:

  • Prospect Rental Services shall not be liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the total amount paid for your booking
  • We are not responsible for theft, loss, or damage to personal belongings
  • We are not liable for circumstances beyond our reasonable control

10. Prohibited Activities

The following activities are strictly prohibited at our properties:

  • Illegal drug use or distribution
  • Prostitution or solicitation
  • Any form of harassment or threatening behavior
  • Commercial filming or photography without written consent
  • Operating a business from the property
  • Subletting or re-renting the property to others

Violation of these prohibitions will result in immediate termination of your stay without refund and may result in legal action.


11. Intellectual Property

All content on prospectrentalservices.com including text, images, logos, and design is the property of Prospect Rental Services and is protected by copyright law. You may not reproduce, distribute, or use our content without written permission.


12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, United States of America. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dallas County, Texas.


13. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the new terms.


14. Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue in full force and effect.

  • Completing the booking and payment process
  • Passing any required identity verification

17. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Agreement to Arbitrate

You and Prospect Rental Services agree that any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, our Privacy Policy, your use of our website, any booking or stay at our properties, or any aspect of our relationship shall be resolved exclusively through binding individual arbitration rather than in court, except as described below.

Informal Resolution First

Before initiating arbitration, both parties agree to attempt to resolve disputes informally:

  1. You must send written notice to info@prospectrentalservices.com describing the dispute and your desired resolution
  2. We will attempt to respond within 30 days
  3. If the dispute is not resolved within 60 days of your notice, either party may initiate arbitration

Arbitration Rules and Process

  • Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
  • The arbitration will take place in Dallas County, Texas, or by telephone/video conference at your request
  • The arbitration will be conducted by a single, neutral arbitrator
  • The arbitrator’s decision will be final and binding
  • AAA rules are available at www.adr.org or by calling 1-800-778-7879

Arbitration Costs

  • For claims under $10,000: we will pay all arbitration fees unless the arbitrator finds your claim frivolous
  • For claims over $10,000: arbitration fees will be split equally between parties
  • Each party bears their own attorney fees unless the arbitrator awards otherwise

Class Action Waiver

YOU AND PROSPECT RENTAL SERVICES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

Exceptions to Arbitration

Either party may seek relief in small claims court for disputes within that court’s jurisdiction. Either party may also seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Opt-Out Right

You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms and Conditions. To opt out, send written notice to:

Opting out will not affect any other terms of this agreement.
